These Terms and Conditions (“Terms”) govern your use of this website and any purchase of goods or services from us. By placing an order or using this website, you agree to be bound by these Terms. Please read them carefully before ordering.
1. About Us
Get Layered is a trading name of Yuniq Technologies Pty Ltd (ABN 69 688 993 053) (“we”, “us”, “our”). Our showroom and warehouse is at 2/219 Albert Road, Warragul VIC 3820. “You” or “your” means the person or business placing an order or using this website.
2. Orders and Acceptance
- Placing an order through this website (including our online upload & quote tool) is an offer by you to purchase goods or services, which we may accept or decline.
- A binding contract is formed only when we confirm your order (for example, by order confirmation email), not simply when you submit it.
- We may decline or cancel an order before production begins — for example, if a model can’t be printed as specified, if there’s a pricing or listing error, or if we’re unable to source a required material. If we do, we’ll let you know and refund any amount you’ve already paid for that order.
3. Pricing and Payment
- All prices are shown in Australian Dollars (AUD) and include GST unless stated otherwise.
- Our upload & quote tool provides an estimated price based on your model’s geometry, chosen material and settings; the price is confirmed when we review your file and finalise your order.
- Payment is required at the time of ordering unless we’ve agreed otherwise with you in writing. Payments are processed securely; we don’t store your full card details.
- If a pricing error occurs (for example, due to a technical fault), we may cancel the affected order and will refund any amount you’ve paid for it.
4. Custom & 3D Printed Products
Most of our products are custom 3D printed to your specifications — from a 3D model file you upload, and the material, colour, infill and quantity you select. Because these goods are made specifically for you, the following additional terms apply.
4.1 Your files and specifications
You are responsible for uploading a printable file and choosing settings that will produce the result you intend. Our quote tool shows a live 3D preview, estimated weight and estimated print time so you can check your model and settings before submitting your order — we produce your order to match exactly what you’ve approved.
4.2 No change-of-mind returns on custom prints
Because these goods are made to your specifications, we are not required to, and generally will not, provide a refund or exchange simply because you change your mind once production has begun. This does not affect your rights under the Australian Consumer Law described in section 6 below — those rights always apply, including if the item is faulty or doesn’t match what you ordered due to an error on our part.
4.3 Dimensional tolerances and material characteristics
3D printing has inherent dimensional tolerances that vary by material, geometry and printer — typically within approximately ±0.2–0.5mm or up to 1–2% of a given dimension. If your project needs precise engineering tolerances, please contact us before ordering so we can confirm whether we can meet them. Printed colour may vary slightly from on-screen previews due to monitor display differences and normal material batch variation, and visible layer lines, minor surface texture and support-contact marks are a normal characteristic of 3D printing rather than a defect.
4.4 Intended use
Unless we’ve expressly agreed otherwise with you in writing, our 3D printed products are not warranted or intended for structural, load-bearing, safety-critical, food-contact, or prolonged outdoor/UV-exposed use. Please tell us before ordering if your part needs to meet any of these requirements, and we’ll let you know whether we can accommodate it.
4.5 Content you supply
If you upload a design file or model that reproduces someone else’s design, logo or trade mark, you must own it or have the right to use and reproduce it. You agree to compensate us for any claim, loss or cost we reasonably incur as a result of a third party’s rights being infringed by content you’ve supplied to us.
5. Delivery and Shipping
- We ship Australia-wide; local pickup is available from our Warragul warehouse.
- Delivery timeframes and estimated order timelines shown on this website (including in our quote tool) are estimates only and are not guaranteed, unless we’ve expressly agreed a fixed delivery date with you in writing.
- Risk in the goods passes to you on delivery. Title (ownership) passes once we’ve received payment in full.
- If a delivery is delayed or lost by a third-party carrier, we’ll work with you and the carrier to resolve it. Our liability is limited as set out in section 9 below, in addition to your rights under the Australian Consumer Law.
6. Australian Consumer Law — Your Guarantees
Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, right or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded, restricted or modified.
Under the ACL, goods and services we supply come with guarantees that cannot be excluded, including that goods will be of acceptable quality, fit for any disclosed purpose, and match their description; and that services will be provided with due care and skill and be fit for any disclosed purpose. If there is a major failure (for example, the goods are unsafe, substantially unfit for their normal purpose and can’t easily be fixed within a reasonable time, or significantly differ from their description), you can choose a refund, a replacement, or to keep the goods and be compensated for any drop in value — plus compensation for any other reasonably foreseeable loss or damage. For a failure that isn’t major, we may choose to remedy it by repair, replacement or refund, provided we do so within a reasonable time.
To the extent permitted by law, and subject to the guarantees above, our liability for a failure to comply with a consumer guarantee in relation to goods or services that are not of a kind ordinarily acquired for personal, domestic or household use or consumption is limited, at our option, to one or more of: replacing the goods or supplying equivalent goods; repairing the goods; paying the cost of replacing the goods or acquiring equivalent goods; paying the cost of having the goods repaired; or, for services, supplying the services again or paying the cost of having the services supplied again.
7. Returns, Refunds and Repairs
- If you believe your order is faulty, not as described, or doesn’t meet a consumer guarantee, contact us at [email protected] with your order details and a description (and photos, where relevant) of the issue — we’ll assess your claim promptly.
- Where the ACL requires a remedy, we’ll arrange a repair, replacement or refund as appropriate at no cost to you, including reasonable return shipping costs for the faulty item where required.
- We may ask you to return the item to us, at our cost where your claim is valid, so we can assess or verify the issue before providing a remedy.
- Outside of your Australian Consumer Law rights, and other than for custom prints (see section 4.2), we may at our discretion accept a change-of-mind return within 14 days of delivery for unused stock items in original condition, less any original shipping cost.
8. Cancellations
You may request to cancel an order before production has begun for a full refund. Once production has begun on a custom order, cancellation may not be possible, or may incur a charge reflecting work already completed and materials used, which we’ll advise you of before proceeding. We may also cancel an order at any time before completion — for example, if we’re unable to produce it as specified — in which case we’ll refund any amount you’ve paid for that order.
9. Limitation of Liability
To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, we exclude all liability for indirect, special or consequential loss arising from your use of this website or our goods or services. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law, including our liability under the Australian Consumer Law.
10. Intellectual Property
All content on this website, including text, images, logos and our upload & quote tool, is owned by or licensed to us and may not be reproduced without our permission. See section 4.5 above for terms relating to content you supply to us.
11. Force Majeure
We won’t be liable for any delay or failure to perform our obligations under these Terms where the delay or failure results from circumstances beyond our reasonable control, including natural disasters, supply shortages, transport disruption or industrial action. If this continues for an extended period, either of us may cancel the affected order for a full refund of amounts paid for undelivered goods or services.
12. Privacy
We handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. If you have any questions about how we collect, use or protect your personal information, please contact us using the details below.
13. Complaints
If you have a complaint, please contact us and we’ll aim to resolve it promptly and fairly. If you’re not satisfied with our response, you can contact Consumer Affairs Victoria or the ACCC for guidance on your rights.
14. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time you place an order applies to that order. Updates will be posted on this page with a revised date.
15. Governing Law
These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
